What Is An Estate Plan?

Estate planning is a broad term that entails many different aspects of managing a person’s assets and properties when they pass away or become incapacitated. Each person’s plan is crafted based on their own personal needs and wishes, as well as the assets they possess. Some documents that may be included in an estate plan are:

  • Will – many times, an estate plan will include a will. There are two types of wills a person could have: a living will, and a last will and testament. A living will may also be known as an advance directive, or a document specifying an individual’s wishes regarding medical treatment if they should become incapacitated or unable to make those decisions themselves. A last will and testament is different because it outlines how a person’s assets and/or property will be distributed after they pass away.
  • Living Trusts – these are created when a person transfers their assets and/or property into a trust while they are still alive. The trust is still able to be controlled, managed, and revised by the trustee, or the person in charge of the trust. When that person dies, the trust is then transferred to the individual they want to inherit the trust, also known as the successor trustee.
  • Power of Attorney – this is when you name a person who is able to make financial, health-related, and other legal decisions in your place if you are not able to. It can be temporary or permanent (durable).
